The apex court directed the Centre to provide reservations in promotions for SC/ST employees as per law on the special writ petition.
However, as per the notification released by the Bihar government that says, "Such promotions would be granted in accordance with the further orders of the Supreme Court."
“The decision in this regard has been taken on the recommendations made by the high-level officials of the state government and Secretary General/Secretary-level officials. The committee was constituted for the purpose on June 27 following an advice received from the Union Personnel and Training Department,” the statement read.
The notification released by the government also mentions detailed information about the reservation in promotion to SC/ST.
The Supreme Court on June 5 granted permission to the Centre to provide reservations in promotions for SC/ST employees as per law until the issue is adjudicated by its Constitution Bench.
The apex court bench of Justice Adarsh Kumar Goel and Justice Ashok Bhushan had been hearing a plea from the Centre against an August 2017 judgment of the Delhi High Court which had quashed a DoPT memorandum from 1997, which provided for the continuation of reservation in promotions indefinitely.
