Triple Talaq To Become A Criminal Offence, Cabinet Clears Proposed Bill

During the winter session of Parliament which began today, a bill proposing the Muslim practice of instant divorce by saying "talaq" three times infamously known as Triple Talaq as a criminal offence has been cleared by the union cabinet and the government is now hoping to receive the parliament clearance during the short session.

Triple Talaq has become an epidemic for Muslim women in the recent times, one of whom when appealed against the existence of the loathed practice, the entire nation joined the campaign. Supreme Court took a revolutionary decision in August by announcing the practice unconstitutional, however, the lack of punitive actions allowed many to continue the instant divorce custom.

The recent cases of triple talaq given by using social media platforms like WhatsApp and Skype have prompted the government to mull over the violation of equal rights of women. The proposed bill called the Muslim Women (Protection of Rights on Marriage) Bill is government's "priority agenda".

The draft for the bill has been drafted by a group of ministers led by Home Minister Rajnath Singh. Calling the instant divorce custom as arbitrary, a five-judge bench, comprising Justices JS Khehar, Kurian Joseph, Rohinton F Nariman, UU Lalit and Abdul Nazeer, SC struck down Talaq-e-biddat in August.

The panel notified, "in view of the different opinions recorded, by a majority of 3:2 the practice of talaq-e-biddat - triple talaq - is set aside." Muslim men use the practice to divorce their wives by mentioning the word ‘talaq (divorce)’ thrice in one go.

According to the present law, a victim of the practice can approach the land of law but the absence of punitive provisions doesn't allow the Police to take action against the Husband. Even the Muslim clergy doesn't help the case.
