No Floor Test, No Stay On AIADMK Legislators' Disqualification: Madras HC

The Madras High Court on Wednesday ordered that no floor test should be held in Tamil Nadu assembly adjourning the case till October 4 without staying the disqualification of 18 rebel AIADMK MLAs.

News Agency ANI reported, " Madras HC directs no election notification to seats of 18 disqualified MLAs. No stay on the disqualification. Case adjourned to 4 October."

Justice M. Duraiswamy gave his order hearing the petition filed by the legislators disqualified by the Speaker P. Dhanapal on Monday.

The judge also highlighted that no by-elections will be conducted for the vacant seats as a result of the disqualification.

According to reports by ANI, as the hearing began in Madras High on plea of 18 disqualified MLAs, TTV Dinakaran's lawyer Dushyant Dave claimed that the anti-defection law was being misused by the speaker.

Asking why no committee was constituted according to laws of Assembly to enquire MLAs, Dave claimed that the speaker was influenced by somebody.

He said, "MLAs didn't vote against party or resigned. So why the question of anti defection? Speaker is depriving the rights of MLAs."

After the hearing, Aryama Sundaram, the lawyer of Tamil Nadu Speaker confirmed that there will not be floor tests for next days until counters are filed.

Last week, the court had extended the stay on Tamil Nadu assembly floor test till Wednesday.

The opposition DMK had petitioned the court after the state governor C. Vidyasagar Rao didn't conduct the floor test despite numerous requests.
