Muzaffarpur Shelter Home Rapes: SC Sets Aside Media Gag Imposed By Patna HC

The Supreme Court on Thursday quashed the Patna High Court’s order imposing ban on the reporting of the Muzaffarpur Shelter Home Rape Case.

A division bench presided by Justice Madan B Lokur and Justice Deepak Gupta set aside the August 23 order of the Patna High Court allowing the media agencies to report about the incident but has asked the media not to publish any picture of the victims whether morphed or blur.

The apex court had on Tuesday stayed the Patna High Court order allowing CBI Special Director to constitute a fresh Special Investigation Team (SIT) in the case. It said the probe be continued by the earlier team formed by the CBI Director.

Senior advocate Shekhar Naphade, appearing for a scribe who has challenged the Patna High Court order, argued that there were guidelines, including on journalistic ethics, and statutory provisions, but these were being violated as the media was conducting “parallel investigations” and trial.

The senior counsel further said that ‘media trial’ of cases cannot be allowed and they should be asked to do factual reporting.

The bench asked its registry to issue notices to the PCI, Editors’ Guild of India, News Broadcasting Standards Authority and News Broadcasters Association to assist the court and posted the matter for hearing after two weeks.
