8 Years Later, Man Gets Jailed For Calling Woman ‘Chammak Challo’

The legal system in India is infamous for being remarkably slow, resulting in many victims simply avoiding filing legal cases in general, but one woman filed a legal complaint against a man for calling her 'Chammak Chalo' in 2009 and 8 years later the accused has been jailed.

A magistrate's court in Thane convicted a Ghodbunder Road resident for calling a woman chammak chalo in 2009, fining him Re 1 and sentencing him to 'simple imprisonment till rising of the court' meaning until the court proceedings are over for the day.

The accused was found guilty under section 509 (word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code by First class judicial magistrate R T Ingale.

According to reports, the complainant and her husband were returning home from a morning walk on January 9, 2009, at 9:15 AM when the woman's leg accidently touched the dustbin of their neighbour, the accused, and it fell over. The accused became furious thinking that the woman kicked the dustbin on purpose and shouted at the woman and her husband, calling her a 'chammak challo'.

The woman claimed that the words insulted her modesty and approached the housing society where they both lived but no action was taken, following which the woman reached the court.

The judge said that the words 'chammak challo' are to be understood in the Indian society by their usage and generally the words are used in a degrading manner, which is consistent with insulting the modesty of a woman, making applicable section 509 of the IPC.
