64 MPs Sign Impeachment Motion Against Chief Justice of India Dipak Misra

Weeks after the Congress party first announced intentions for the impeachment of Chief Justice of India Dipak Misra, on Friday Opposition parties took the unprecedented first step toward the CJI's impeachment.

The Opposition parties submitted a petition with 71 signatures to Vice President Venkaiah Naidu, the chairman of the Rajya Sabha in Parliament, out of which 7 had to be nullified since the MPs have retired, leaving the final number at 64.

The leader of opposition in Rajya Sabha Ghulam Nabi Azad announced the move in a press conference after meeting with vice president Venkaiah Naidu.

"We have moved an impeachment motion seeking the removal of CJI Dipak Misra," said Azad.

"71 MPs had signed the impeachment motion (against CJI) but as 7 have retired the number is now 64. We have more than the minimum requirement needed to entertain the motion and we are sure that the Hon Chairman will take action," Azad added.

Continuing the press conference, senior advocate and Congress leader Kapil Sibal alleged that there had been questions regarding Dipak Misra since his appointment as CJI in August 2017.

"We wish this day had never come in the fabric of our constitutional framework. Since the day he (Dipak Misra) was appointed as CJI there have been questions raised in the manner in which he has dealt with certain cases," said Kapil Sibal.

The veteran Congress leader also referred to the press conference called by senior judges of the Supreme Court in January, alleging arbitrary allocation of cases by CJI Misra.

"When the judges of the Supreme Court themselves believe that the Judiciary's independence is at threat, alluding to the functioning of the office of the CJI, should the nation stand still and do nothing?" Sibal said.

The impeachment move comes a day after a Supreme Court bench led by CJI Misra dismissed a petition seeking a Special Investigation Team probe into the death of Justice Loya. The judgment of the apex court in the Justice Loya case had been criticised heavily by the Congress.

According to Article 124(4) of the Constitution of India,  "A Judge of the Supreme Court shall not be removed from his office except by an order of the President passed after an address by each House of Parliament supported by a majority of the total membership of that House and by a majority of not less than two-thirds of the members of that House present and voting has been presented to the President in the same session for such removal on the ground of proved misbehaviour or incapacity."
