SC Quashes FIR Against Priya Prakash Varrier, CJI: Someone Sings A Song & You File A Case?

The Supreme Court on Friday quashed the FIR against Malayalam Actor Priya Prakash Varrier and the director and producer of the film ‘Oru Adaar Love’ for hurting the religious sentiments.

A three-judge bench of Chief Justice of India, Dipak Misra, Justice AM Khanwilkar and DY Chandrachud were hearing the matter.

The bench hearing the matter ruled that the winking scene in the movie Oru Adaar Love will not be hit by Section 295A of the Indian Penal Code. The bench held that no criminal complaint shall be entertained in this matter.

Chief Justice Misra remarked the State counsel and said, “Somebody in a film sings a song and you have no other job but to file a case.”

The petitioners had approached the Supreme Court seeking the quashing of the FIR registered in the state of Telangana and the criminal complaints in for allegedly hurting the religious sentiments of Muslims.

The petition says, “criminal complaints have been instituted by various fringe groups based on a distorted and incorrect interpretation of the Song in the states of Telangana, Maharashtra and similar complaints are likely from other non-Malayalam speaking states as well”.

The criticism emerged as the lyrics of the song “Manikya Malaraya Poovi” is a traditional Muslim song from the Malabar region of Kerala. The song describes and praises the love between the Prophet Mohamed and his first wife Khadeeja.
