SC Rejects Abortion Plea For 10-Year-Old Rape Survivor, Despite Medical Report

The Supreme Court has rejected the plea of a 10-year-old rape survivor to terminate her 32-week-old pregnancy despite a report from the medical board which said that the minor's health could be at risk.

On July 24, a bench comprising of Chief Justice JS Khehar and Justice DY Chandrachud had asked the Chandigarh Legal Services Authority to assist it as an amicus curiae and get the minor examined by a board of doctors on July 26 to determine whether termination of the pregnancy would put the girl's life in danger.

To undergo the medical assessment, the girl and one of her parents were accorded transportation for the medical exam at the PGI, Chandigarh.

The matter reached the Supreme Court after a Chandigarh district court on July 18 refused to allow the girl to undergo an abortion when it was confirmed that she was 26-weeks-pregnant.

According to the Medical Termination of Pregnancy Act, courts can allow medical termination of pregnancy up to 20 weeks of gestation and can make exceptions if the foetus is found to be genetically abnormal.

"Medical experts have categorically opined that if the 10-year-old rape survivor is forced to give birth through normal delivery or C-section, it may be fatal to the life of the girl as well her child," the petition filed through advocate Kedar Nath Tripathy had said.
