In another slug with the Delhi Chief Minister Arvind Kejriwal, senior Advocate Ram Jethmalani has claimed that the AAP supremo did instruct him to use derogatory words against Finance Minister Arun Jaitley.
Ram Jethmalani had quit Kejriwal’s legal counsel after he denied having instructed him of using derogatory language against Union Minister Arun Jaitley during the case briefings.
Referring to the affidavit Kejriwal had written to the court, the noted lawyer claimed that the AAP leader had, in fact, told him to use derogatory words against Arun Jaitley in the court.
Arvind Kejriwal had sent an affidavit to the court on July 20 saying, “With due respect, it is submitted that neither Kejriwal nor the Counsel briefing the senior counsel Jethmalani gave instructions to the senior counsel to use the objectionable words on May 17, 2017.”
In a court appearance on May 17, Jethmalani had used an offensive word regarding Jaitley, amounting to accusing Jaitley of being a criminal to which Jaitley asked if the words were used on the instructions of Kejriwal. When the advocate replied in the affirmative, Jaitley filed another Rs 10 crore defamation suit against the CM.
Jethmalani sent a letter to Kejriwal and forwarded it to Jaitley as well. His letter to Kejriwal on July 20 said, “When Arun Jaitley filed the first suit and the criminal case, and you naturally sought my services. Ask your conscience how many times you used worse abuses than a mere '.......' (the derogatory word Jethmalani had used against Arun Jaitley in court).
It added, "You have hundred times asked me to teach this '......' a lesson. Incidentally, for the last couple of weeks, you only met me briefly. However, your assistant Raghav Chadha and advocate Anupam Srivastava have been briefing me in the matter. Of course, the law is settled that no suit for damages lies against parties and lawyers even if the suggestion made only in court judicial proceedings proves to be false or malicious."
"But please do not misunderstand; I am not advising you to continue the fight. If you think Jaitley will withdraw the suit on seeing this letter to me (sic), do by any means settle with him. I will take the consequences. One thing is certain, I will not now appear in any matter for your defence, only pay the settled fees for first matter and nothing for the second” he had added.
