Responding To Gautam Gambhir's Plea, HC Issues Notice To Bar Owner For Using Player's Name

Delhi-based batsman Gautam Gambhir might be out of the national team currently but his past stints have garnered him a great fame. In order to safeguard the interest of his followers, the player recently pleaded to the state's High Court for restraining a restro-bar chain owner from using his name in the tagline.

Responding to the batsman's plea, High Court issued a notice to the state-based restaurant chain's owner seeking a response to the query. Notably, the plea was earlier rejected by a single judge bench but the division bench of Justices G S Sistani and Sangita Dhingra Sehgal has rather taken the issue into consideration.

The notice has been issued to DAP and Co - a company which runs the pubs called Ghungroo and Hawalat in Punjabi Bagh area of west Delhi. Surprisingly, the pub's owner's name is also Gautam Gambhir, who has been asked to present his stance before the court on March 20.

A single judge bench rejected the plea on December 13, 2017 citing, "Nothing has emerged on record if there was any loss to the goodwill of the plaintiff (cricketer) in his field i.e. Cricket because of running of the restaurants by the defendant (pub owner) with the tagline in his own name."

Challenging the order, Gautam then reproached the court through senior advocate Rajiv Nayar contending that the name Gautam Gambhir gets directly associated with the cricketer and the owner has run the restaurant with the tagline 'by Gautam Gambhir', despite the player having no connection with it.

The plea further brought the confusion created by the tagline in public's mind, a discovery which the cricketer made in November 2016. The first restaurant called 'Blu Waves by Gautam Gambhir' was launched in Rajouri Garden whereas another one under the name 'Play Reloaded by Gautam Gambhir' was opened in Rajouri Garden.
